7. To whom we will transfer your data?

Processors, i.e. companies that we oblige to process data within the legally defined scope, Article 28 of the GDPR (service providers, agents). In this case, the responsibility for protecting your data remains with Deutsche Telekom Services Europe Slovakia. We use companies mainly in the areas of: IT, HR, finance.

Business partners who, on their own responsibility, provide services for you or in connection with your contract with us. This is the case if you order the services of these partners from us, if you agree to the involvement of the partner, or if we involve the partner based on the legal permission.

In relation to legal requirements: In certain cases, we are legally obliged to transfer certain data to a government authority that requests it.

We provide detailed information about the categories of current recipients of personal data in the Privacy Policy.

8. Where are your data processed?

Your data will be processed in Slovakia and other European countries. If, in exceptional cases, your data is processed in countries outside the European Union (so-called third countries), the processing will take place:

a.  if you have expressly consented to this (Article 49(1) GDPR). (In most non-EU countries, the level of data protection does not correspond to EU standards. These include, in particular, the complex monitoring and control rights of state authorities, e.g. in the US, which disproportionately interfere with the data protection of European citizens, or

b.  to the extent necessary for us to provide you with our services (Article 49(1)(b) GDPR), or

c.  to the extent required by law (Article 49(1)(c) GDPR).

In addition, your data will only be processed in third countries if certain measures ensure an adequate level of data protection (e.g. EU Commission adequacy decision or appropriate safeguards, Art. 44 et seq. GDPR).

Your data is mainly stored on our servers in the EU, however, to the necessary and minimal extent, third party cookies may be transferred to the USA. Some of our vendors that we use to use cookies or various plug-ins integrated into our websites are based, or their other group companies are based, in the United States of America, which is generally considered a third country that does not guarantee an adequate level of protection. In many cases, data may not physically leave servers located in the EU, but processing due to the location of the supplier may be subject to third country law. We therefore only carry out these cross-border transfers in strict compliance with the law (in particular the GDPR) and only where our findings and conclusions are that sufficient measures are in place to mitigate the risks to data subjects, as set out by the CJEU in case C-311/18 (Schrems II).

On 10 July, 2023 the European Commission adopted its adequacy decision for the EU-U.S. Data Privacy Framework. The adequacy decision concludes that the United States ensures an adequate level of protection – compared to that of the EU – for personal data transferred from the EU to US companies participating in the EU-U.S. Data Privacy Framework. Notably, the new obligations were geared to ensure that data can be accessed by US intelligence agencies only to the extent of what is necessary and proportionate, and to establish an independent and impartial redress mechanism to handle and resolve complaints from Europeans concerning the collection of their data for national security purposes.

Simple links (links) are also available on our Website that allow an immediate connection between our Website and our profile set up on a social network or other platform (Instagram, Facebook, YouTube, LinkedIn, among others). In these cases, these are not active plug-ins that cause data processing that requires the consent of logged-in or non-logged-in users of these social networks.

However, in the case of interaction with icons displaying individual social networks, cookies and personal data may be processed on the part of the social network provider, over which we may have no control or influence. Deutsche Telekom Services Europe Slovakia is not responsible for this use of cookies.
